TREE APPEAL - 4:00 P.M.
(1) 318 Niagara Blvd - Peter & Laurie Nixon

Kristina visited property on August 18, 2021. The tree is a Hornbeam tree, it is very large and may have outgrown it’s space, but was in good condition.

Peter and Laurie Nixon stated on August 23, 2021 Kristina denied request for removal of tree. Agreed tree is healthy. Hornbeam or Ironwood tree, planted 15 years ago, 5 feet from house foundation. When planted they relied on landscaper to plant a tall tree that didn’t fill out, and that is not what they got. They cannot see out the front windows of house, they have to have lights on from dawn to dusk. Feels gloomy and undermines efforts of being mindful of energy consumption. Branches are only inches from the windows and they get pretty big wind gusts where branches hit the windows. He would like to replace with as tall and mature an emerald cedar as they can find. Not sure if it would be in the exact location based on stump removal.

Moved by Councillor Sandra O'Connor, seconded by Councillor Gary Burroughs that Council approve the staff recommendation not to remove the tree at 318 Niagara Boulevard subject to review by an arborist regarding pruning of the tree.

(2) Meeting to Consider - Irvine Road Drain

Neal Morris, K-Smart Associates Limited was in attendance to speak to the Irvine Road Drain 2020 Final Engineering Report and referred to an electronic presentation providing background information and an overview of the proposed drainage works. Mr. Morris also spoke to the diameter of pipe from a greenhouse running along Irvine Road into the lake.

Charlie Hall
Mr. Charles Hall, stated he was speaking on behalf of himself and his wife, Sandra Hall. He state they have examined the report and are willing to pay those costs. Wants to make certain that it’s not just a few residents left paying the costs. All 22 properties on the waterfront will benefit from this. If the township can share in the costs that would be appreciated. Mr. Hall stated he was also speaking on behalf of Judy Benezra, resident, and Ms. Benezra was also in support of the report.

Mary Lou Tanner, Agent for the applicant referred to an electronic presentation and referenced the following: Property & Consent Sketch, 2006 Aerial Photo, the Agricultural Use, Drainage System, Agricultural Impact Assessment, No Policy Basis for Cumulative Impact, Niagara Region Comments - August 2021, Niagara-on-the-Lake Official Plan and reasons for the consent to be approved.

Mr. Wall provided further information in support of the consent. He stated the soil on farm is very heavy clay and referenced the "Drainage System" slide in the presentation to provide more detail on the system. Mr. Wall further stated he would like green energy system to help support Town initiatives. The consent will not change anything except the legal boundary.

    Queen-Mississagua Entranceway Project

    Gracia Janes, speaking on behalf of the Niagara-on-the-Lake Conservancy stated they were hoping for an open public meeting on this important subject that affect the hear of the Town heritage area. She further stated the Conservancy supports option three. Ms. Janes answered questions from Council.

    Kevin Turcotte, Manager of Parks & Recreation introduced both Brad Smith & Haig Seferian, Seferian Design.

    Mr. Turcotte, Mr. Smith and Mr. Seferian referred to a electronic presentation. The following was referenced for the Queen & Mississagua Entrance Project, Fort Mississagua Aerial view, Fort Mississagua, Stone Archway, Downtown Niagara-on-the-Lake, Pillar & Post Garden Expansion, Dry Stack, Stone Archway, First Lighthouse on the Great Lakes, Existing Site Conditions. Mr. Turcotte then spoke to the proposed (Re)Design, Project Vision, Concept Design Summary, What We Heard (from “Join the Conversation”), Plan View Section, Option 1 & Option 2, Project Scale, Existing Site Condition Dimensions, Proposed Scale – Option 1 & Option 2 and Council options. Ms. Janes also provided comments on behalf of Mr. and Mrs. Alexander in support of option three.

    Mr. Turcotte, Mr. Smith and Mr. Seferian answered questions from Council.

    COVID-19 UPDATE
    Marnie Cluckie, Chief Administrative Officer updated Council on the following:
    • Town remains in Step 3 of the Road Map to Reopen
    • September 14, 2021 Regulations and Guidance to businesses and organizations to support them as they implemented proof of vaccination
    • Ontarians are required to be fully vaccinated with proof of vaccination.
    • Effective September 24, 2021 easing capacity for select indoor and outdoor settings
    • Proof of vaccination will now be required in certain outdoor settings where the normal maximum capacity is 20,000 people or more
    • More than 100 new health and safety inspectors will be graduating today and they will be visiting workplaces in construction, industrial and healthcare settings
    • Province launched the workplace safety plan builder, free interactive tool
    • Farm families across the province will have access to targeted mental health training and services
    • Toronto Public Health planning group preparing for the immunization for kids age 5-11, later this year, maybe into 2022 with Niagara Public Health planning vaccinating the age 5 to 11 group
    • On September 22 Niagara-on-the-Lake launched the proof of vaccination program
    • Public washroom remain open during certain hours
    • Next vaccine clinic is September 29, 2021 at the Community Centre
    • 75.3% of Niagara residents having had their first dose, and 70.2% have a complete series
    • Ontario has one of the highest vaccination rates in the world
    • Traffic over the weekend saw a 12% decrease from last week
    • Environmental Advisory Committee organized a clean up event on September 18, in 2 hours over 30 people participated and collected 12 bags of garbage and recycling on the Parkway
    • Federal Government has declared September 30th as the National Day of Truth and Reconciliation
    • Ambassador Program has concluded for the season, Ms. Cluckie thanked all the Ambassadors who assisted the Town.

    MOTIONS & INFORMATION PACKAGES
    1. The following resolution(s) be adopted:
    (a) Cenotaph 100th Anniversary

    Moved by Councillor Gary Burroughs, seconded by Councillor Sandra OConnor,

    WHEREAS the Cenotaph on Queen St. in the Old Town was unveiled June 3rd, 1922, and it was built as a memorial to the town residents who were killed in action during the First World War.

    WHEREAS it is a unique structure, designed by Charles M. Wilmott, a noted Toronto architect, and its creation came after it received a favourable vote by all the townspeople,

    AND WHEREAS it is the only Cenotaph in Canada located in the center of a street, is the second most photographed Cenotaph in Ontario, albeit by people who see it only as a clock tower and not as a memorial to fallen soldiers, and this iconic structure is used by the Town as part of its branding:
    · Polish Sunday and the Annual Boy Scouts march past this magnificent structure each year, and it is the focal point for Remembrance Day services in the Town;
    · After 100 years, there are repairs that may be required, such as repointing, parging, lighting upgrades, and some landscaping changes, to better reflect its significance as a war memorial;
    · The Legion, Branch 124 is responsible for maintaining the Cenotaph, and has done so, with the assistance of Town staff for many years.

    THEREFORE, BE IT RESOLVED THAT:
    · the Town of Niagara-on-the Lake, and the Town Staff, work with the Legion Committee to help commemorate 100 years of our Cenotaph;
    · while there is no formal request for financial assistance, the event be held on June 3rd, 2022, and be forwarded to the Audit and Finance Committee for their consideration;
    · Parks & Recreation Staff work with the Legion Committee to incorporate the plans for 2022 for planting around the Cenotaph; and
    · the Town participate in a service on June 3rd, 2022, to mark the anniversary of the Cenotaph, and to remember its reason for being.

    (b) Businesses off Queen Street

    Moved by Councillor Wendy Cheropita, seconded by Councillor John Wiens

    WHEREAS, small retail operations and restaurants located off Queen Street but still in the Heritage district pay the same commercial tax as businesses on Queen Street; however, they do not benefit from the beautiful boulevard landscape and floral plantings that define Queen Street as the commercial district in Niagara-on-the-Lake;

    WHEREAS, businesses adjacent to Queen Street, but still within the Queen-Picton Heritage Conservation District, have struggled with finding the options to draw attention to their respective businesses; and

    WHEREAS, one way to address this challenge is to expand the commercial district landscape, floral designs and staff service levels to include adjacent commercial boulevards in the Heritage District. (As an example, include 187 & 188 Victoria Street and Regent Street West
    and King Street East.)
    
    THEREFORE BE IT RESOLVED THAT Operations Staff comment on and provide cost estimates to the Audit and Finance Committee to expand the Queen Street commercial district landscape treatment and service levels to adjacent commercial boulevards in the Queen-Picton Heritage Conservation District for Council's consideration as a part of the 2022 Operating Budget process.

    Whereas routine eye care is critical in early detection of eye diseases like glaucoma, cataracts, and macular degeneration, and the health of eyes is critical to overall health and quality of life; and Whereas conditions that may be detected with an annual eye exam include Diabetes mellitus, Glaucoma, Cataract, Retinal disease, Amblyopia (lazy eye), Visual field defects (loss of part of the usual field of vision), Corneal disease, Strabismus (crosses eyes), Recurrent uveitis (an inflammation of the uvea, the middle layer of the eye that consists of the iris, ciliary body and choroid), Optic pathway disease; and

    Whereas payments from OHIP have only increased 9% over the last 30 years, which has not come close to matching inflation of costs (which include rent, staff, utilities, equipment, taxes and supplies); and

    Whereas the lack of funding makes it difficult to invest in modern technology, and newer technology means earlier detection of eye disease; and Whereas the Provincial government’s refusal to formally negotiate with Optometrists for more than 30 years has forced the Optometrists to absorb approximately 173 Million dollars annually in the cost to deliver eye care to Ontarians; and

    Whereas the 2021 Ontario Budget did not address OHIP-insured eye care, Ontario Optometrists took action and voted to withdraw OHIP services starting 2 September 1, 2021, unless the government agrees to legally-binding negotiations to fund these services at least to the cost of delivery; and

    Whereas this job action will jeopardize good eyecare for those who need the care of an optometrist the most and will have the greatest impact on the most vulnerable groups. Children, who’s lifetime ability to learn and develop depends on good vision and to the elderly, who are at the greatest risk for vision threatening ocular diseases;

    Now Therefore, be it resolved that the Municipality of Niagara-on-the-Lake requests that the Provincial government recognize the value that access to quality eye care brings to all Ontarians and act now to protect it;

    And further that the Provincial government address the OHIP-insured eye care immediately and enter into legally-binding negotiations with Ontario Optometrists to fund these services at least to the cost of delivery, prior to any job action taking place;

    And further that a copy of this resolution be forwarded to Premier Ford, Ontario Minister of Health Christine Elliot, MPP Dave Smith, MPP David Piccini, MPP Laurie Scott, to the Ontario Association of Optometrists, and to all municipalities in Ontario.
