1. Call to Order

The meeting was called to order by the Chair at 6:30 p.m.

2. Adoption of Agenda

Moved by Councillor Bisback that the agenda be amended to include MHC-21-11 - 12 Queen Street - Heritage Permit Application - Installation of Mechanical Equipment under Business and designation of St. Mark's Anglican church, grounds and rectory under New Business.

APPROVED AS AMENDED.

3. Conflict of Interest

Drew Chapman declared a conflict with MHC-21-008 - 95 Johnson Street, The Post House - Heritage Permit Application - Alterations to 1999 Solarium Addition, as he is involved with the project.

4. Previous Minutes

The Committee was in receipt of the February 9, 2021 Minutes.

7. Correspondence

The Committee was in receipt of a letter from 2233497 Ontario Limited, signed by Steven Megannety regarding 46 Paxton Lane.

Moved by Ken Douglas that the correspondence be received and that staff bring back a report at a later date.

8. Business

8.1 MHC-21-007 - 135 Queen Street - Fulfilment of Conditions for Heritage Permit H-18-023

Denise Horne described the application and the required fulfilment of conditions.

Jeremy Tran, acting as the agent from the Niagara Planning Group, along with the project's landscape architect, were in attendance and spoke to the application.

Moved by Philip Hoad that the recommendations contained in MHC-21-007 - 135 Queen Street - Fulfilment of Conditions for Heritage Permit H-18-023 be approved as follows;

1.1 Condition #3 of Heritage Permit H-18-023 for 135 Queen Street, pertaining to final approval of the water fountain, be considered satisfied by the Municipal Heritage Committee, and the water fountain be designed substantially in accordance with the designs submitted in Appendix A of the staff report (MHC-21-007); and

1.2 Condition #4 of Heritage Permit H-18-023 for 135 Queen Street, pertaining to the provision of additional trees on the Landscape Plan, be considered satisfied by the Municipal Heritage Committee as per the approved landscape plan in H-18-023 (see Appendix B of the report).

APPROVED.


8.2 MHC-21-008 - 95 Johnson Street, The Post House - Heritage Permit Application - Alterations to 1999 Solarium Addition

Drew Chapman (Chair) previously declared a conflict and Rita Trudeau (Vice Chair) took the position of Chair.

Denise Horne described the application.

Mark Edwards, from Edwards Designs, acting as the agent , was in attendance and spoke to the application.

The Committee discussed the matter.

Moved by Ron Dale that the recommendations contained in MHC-21-008 - 95 Johnson Street, The Post House - Heritage Permit Application - Alterations to 1999 Solarium Addition be approved as follows;


1.1 The Heritage Permit Application to alter the 1999 solarium addition at 95 Johnson Street be approved, to the satisfaction of the Director of Community and Development Services and subject to the following conditions:

    1.1.1 The alterations be undertaken substantially in accordance with the proposed elevation drawings provided by Edwards Designs, and dated February 22, 2021, attached as Appendix A of the staff report (MHC-21-008); and

    1.1.2 The applicant consider the use of glass panes similar in size to the existing window panes on the 1835 structure.

APPROVED.


8.3 MHC-21-009 - Memorandum - Updating the Municipal Register of Properties of Cultural Heritage Value or Interest

The Committee was in receipt of the memorandum.

Denise Horne delivered the contents of the memorandum and explained the details of such.


8.4 MHC-21-010 - Request for Comments - Temporary Patio Permit Program

Denise Horne delivered the contents of the report and explained the details of such.

The Committee discussed the matter.

Moved by Amanda Demers that the recommendations contained in MHC-21-010 - Request for Comments - Temporary Patio Permit Program be amended as follows;

1.1 The Municipal Heritage Committee provide comments on the parameters of the 2021 Temporary Patio Permit Program as it impacts heritage designated properties within the Queen-Picton Heritage Conservation District and any Part IV designated heritage properties; and

1.2 Council adopt the following program parameters for the 2021 Temporary Patio Permit Program as it impacts designated heritage properties:
    1.2.1 Patios be constructed of wood or metal rather than plastic;
    1.2.2 Patios be natural or stained wood or painted in a colour from the approved Niagara-on-the-Lake approved colour chart (or similar) to the satisfaction of the Director of Community and Development Services;
    1.2.3 Lighting on patios be simple in design, of a warm white light, that illumination be directed downward, and that no colour changing or flashing lighting is permitted to the satisfaction of the Director of Community and Development Services;
    1.2.4 Decorative free-standing flower pots or planting boxes are encouraged;
    1.2.5 No signage is permitted to be installed on the patio structure with the exception of one menu sign at a maximum size of 0.2 square metres in area;
    1.2.6 A Heritage Permit is required to be obtained by a property owner for the construction of any patio temporary or otherwise, which will result in soil disturbance or excavation, including the pouring of below-grade footings, or slab on grade foundations, or where any patio structure is proposed to be attached to an existing building or structure,
    1.2.7 Heritage Staff review and provide comments on all Temporary Patio Permit Program Applications; and
    1.2.8 That non-branded umbrellas be used exclusively. If shade is required then non-branded pergolas and umbrellas are used instead of tents.
APPROVED AS AMENDED

Moved by Ken Douglas that the following condition be included;


    1.2.9 That Committee ask that Council continue to commit to the December 31, 2021 deadline and that pre-pandemic Queen streetscape conditions be reinstated.
APPROVED.


8.5 MHC-21-11 - 12 Queen Street - Heritage Permit Application - Installation of Mechanical Equipment

Denise Horne delivered the contents of the report and explained the details of such.

John Paraskevopoulos, property owner, was in attendance and spoke to the application.

The Committee discussed the matter.

Moved by Amanda Demers that the recommendations contained in MHC-21-11 - 12 Queen Street - Heritage Permit Application - Installation of Mechanical Equipment be approved as follows;

1.1 The Heritage Permit Application for the installation of mechanical equipment on the roof at 12 Queen Street be recommended for approval subject to the following conditions:
    1.1.1 Any mechanical equipment that might be visible from Queen Street be appropriately screened from view to the satisfaction of the Director of Community and Development Services.

APPROVED.


9. New Business

9.1 Designation of St. Mark's Anglican Church, Grounds and Rectory

Councillor Cameron discussed St. Mark's and the collection of applicable properties. Councillor Cameron suggested that designation of the church and applicable properties be considered and asked staff and Committee members for their input.

General discussion ensued.

Moved by Councillor Cameron that Council direct the Heritage Planner to approach the Parish of St. Mark's for a discussion about potential designation of the church, cemetery and rectory lands, and that the Heritage Planner begin to compile any applicable research in preparation for a potential designation under Part V of the Ontario Heritage Act. And that staff engage the Town Historian in this process, and aim to work with the property owner; and identify any requirements for consultant expertise if needed and bring back a report to the Municipal Heritage Committee on this matter.

APPROVED.

9.2 Hoarding on Queen Street

Councillor Cameron noted that this matter was given consideration at the Council level. Councillor Cameron asked that staff bring the matter back to the Committee for consideration. Denise suggested that guidelines and standards be developed.

Moved by Councillor Cameron that a future discussion occur at the Municipal Heritage Committee with the benefit of a staff report on options to set standards for hoarding in the Heritage District.
