COMMITTEE OF THE WHOLE MEETING MINUTES/REPORT



The members of the Committee of the Whole met on Monday March 08, 2021 in the Council Chambers, at 06:00 PM.

 
PRESENT:
This meeting was held via Video Conference due to COVID-19 and public health concerns and was able to be viewed via Livestream on the Town's website.

1. CALL TO ORDER

Chair Councillor Clare Cameron called the meeting to order at 6:00 pm

2. ADOPTION OF AGENDA
The following members requested to speak under New Business: Councillors Gary Burroughs.

Moved by Councillor Norm Arsenault that the agenda be adopted, as amended.

APPROVED, AS AMENDED.

3. CONFLICTS OF INTEREST
Councillor Erwin Wiens declared a conflict of interest with CDS-21-006 - 1072 Concession 2 Road as he leases the property.

4. COVID-19 UPDATE

Marie Cluckie, Chief Administrative Officer provided the following updates:

Provincial Framework and Colour Zone: Effective March 1st Niagara-on-the-Lake is now in the Red Control Zone. The Town's website has an updated FAQ page with the Section 22 order. A media release and outreach to various groups like short term operators with the changes has been done.

Provincial Funding - Ministry of Municipal Affairs & Housing announced the government will be providing an additional $500 million to Ontario municipalities. Niagara-on-the-Lake will receive $427,007 in two instalments. The amount received is based on the number of COVID cases.

Vaccine Program - On March 4, 2021, 11 locations announced in the Region. In Niagara-on-the-Lake the Community Centre will be location. Public Health has picked the locations based on not having to travel more than 15 minutes to get to a location. The Province in now in phase 2 of the three phase framework. The Region has now been deemed a "hot spot", and should be receiving more vaccines. In regards to offers to volunteer, please contact Niagara Region Public Health as there are many opportunities to help.

Enforcement - The Town continues to be quiet, as residents are following rules and staying safe. Staff continue to view the regulations for anticipation of moving to the Orange Zone, once that has been announced.

Customer Service Survey - As many changes have been made to technology in regard to the pandemic, staff are preparing a survey looking for responses on how the Town is doing and how things can improve.

Flags at Half Mass - we partnering with other municipalities across the region to lower flags as the one year anniversary mark of COVID.

Mental Health & Wellness - The Town continues to support staff to ensure all supports are in place to help.

Post Card Initiative - Sign up and receive a prepaid postcard to send to family member or a friend during this difficult time.

Members asked questions with regard to the updates.

5. DELEGATIONS/ PRESENTATIONS
5.1 John Foreman, President, NOTL Bed & Breakfast Association
- STR Situation in 2021

John Foreman provided briefing notes on his presentation for the Committee. Mr. Foreman stated he was before the Committee to explain the situation, on behalf of the Bed and Breakfast Association members, that they are facing in 2021. Mr. Foreman was requesting flexibility with licenses and invoicing and a fee reduction for 2021 by either a prorated approach by months or reducing the fees by 33%. Mr. Foreman answered questions from the members.

6. RESPONSE TO DELEGATIONS
5.1 Short Term Rentals

Moved by Lord Mayor Betty Disero that the presentation from John Foreman, Presentation of the Bed and Breakfast Association, be referred to staff for review and report back at the March 15, 2021 Committee of the Whole General Meeting;

And further that that the Short Term Rental Committee terms of reference be amended to include two additional members, and that Claire Cronier and Rene Brewer be appointed as members to the committee.

7. STATUTORY PUBLIC MEETINGS
The Chair explained the process for public meetings and read the Planning Act requirements for submission of an appeal to the Local Planning Tribunal.

At the request of the Chair, it was confirmed by the Town Clerk that notice of the public meeting to inform the public of the proposal, was complied with as per the Planning Act.

The Chair advised that anyone wishing to receive notice should leave their name with the Clerk.

7.1 152-154 Carlton Street & 600 Stewart Road - zoning by-law amendment

At the request of the Chair, Jesse Auspitz, Planner II, Community & Development Services referred to an electronic presentation and explained that an application to amend the Zoning By-law has been received for the subject lands to rezone the residential portion (Part 1) to Rural (A) with site-specific provisions for lot area, building setbacks and the height of existing accessory buildings and structures. The agricultural portion (Part 2) is proposed to be rezoned to “Agricultural Purposes Only (APO)” with a site-specific provision to recognize the existing full-time farm help house. The proposed Zoning By-law Amendment is required to fulfill conditions of consent to sever a surplus farm dwelling (Consent Application B-06/19).

The Chair noted there were two participants who registered to speak to the proposal.

Patrick Maloney, Solicitor, Sullivan Mahoney and Heather Sewell, Planner, Niagara Planning Group

Patrick Maloney stated that both himself and Heather Sewell were representing the owners of the application. Mr. Maloney further stated that this is an application for a technical zoning amendment to satisfy conditions of consent that were imposed by an LPAT decision from November 2020. Mr. Maloney provided a brief summary of the green house operation on the site. Langadon nurseries is a large operation with over 75 acres of land. Part 2 will be acquired and form part of the operation and will be kept as Agricultural Purposes.

7.2 409 Mississagua Street - zoning by-law amendment

At the request of the Chair, Mark Iamarino, Senior Planner, Community & Development Services referred to an electronic presentation and explained that an application to amend the Zoning By-law has been received to rezone the subject lands to “Established Residential (ER) – Site Specific” to facilitate the severance of one (1) new lot for a single-detached dwelling. A lot with an existing single-detached dwelling would be retained. The proposed site-specific provisions pertain to lot frontage, lot depth, lot coverage, front, rear and side yard setbacks, and encroachments. Mr. Iamarino answered question from the Committee.

The Chair noted there were two participants who registered to speak to the proposal.

Craig Rohe, Senior Planner, Upper Canada Consultants and Michael Allen, Architect, ARK Architects

Craign Rohe spoke to an electronic presentation that outlined the proposal for a specific zoning by-law. Also provided was an aerial view, proposed consent sketch and pictures of the existing dwelling; flankage area with driveway access, treed area on William Street and the vacant area where new dwelling is to be constructed. A rendering of the new dwelling was also also shown. Mr. Rohe also spoke to the treed area on William Street which has been evaluated and has no species of concern. A rationale for the development was provided and supporting studies and material were noted. Mr. Allen answered questions from the Committee.

8. CONSENT AGENDA

CDS-21-006 File No. ZBA-17-2020 - 1072 Concession 2 Road
Application for Zoning By-law Amendment


Councillor Erwin Wiens previously declared a conflict of interest with CDS-21-006 - 1072 Concession 2 Road as he leases the property. He didn't take part in any discussion or vote on this matter.

Moved by Councillor John Wiens that the recommendations contained in Community & Development Services Report CDS-21-006 be approved as follows:
1.1 The application for Zoning By-law Amendment (File No. ZBA-17-2020) for the lands known municipally as 1072 Concession 2 Road be approved; and
1.2 The draft Zoning By-law Amendment, attached as Appendix III to this report, be forwarded to Council for adoption.

APPROVED.
