1. Call to Order
Chair Drew Chapman called the meeting to order at 6:30 p.m.

2. Adoption of Agenda
Moved by Councillor Clare Cameron that the agenda be approved, as presented.

APPROVED.

3. Conflict of Interest

Drew Chapman declared a conflict of interest with 135 Johnson Street - Heritage Restoration and Improvement Grant and Heritage Permit - Construct wood storm windows and window shutters, as he has involvement with the property.

Drew Chapman declared a conflict of interest with 18 Prideaux Street - Heritage Restoration & Improvement Grant and Heritage Permit - Construct Wood Shutters, Windows, Storm Windows and Screens, as he has involvement with the property.

Drew Chapman declared a conflict of interest with 159 King Street - Heritage Restoration & Improvement Grant and Heritage Permit - Build, Paint and Install Shutters, as he has involvement with the property.

4. Previous Minutes
The Committee received the Minutes from the September 10, 2019 meeting.

5. Presentations

5.1 Adding and removing properties from the Town's Municipal Register

Denise Horne, Planner II presented information regarding how properties are added and removed from the Town's Municipal Register. The Committee discussed the process and asked questions and provided their concerns.

6. Announcements
There were no announcements at this time.

7. Correspondence

7.1 Regional Council Minutes concerning grant programs

Denise Horne provided information on the Regional Council minutes with regard to the grant programs and explained that a decision has yet to be confirmed by the Region. The Committee discussed this matter.

7.2 Committee Resignation Letter from Janice Johnston

Chair Drew Chapman noted that Janice Johnston has retired from the Committee and thanked Janice for her long term volunteer service.

Moved by Councillor Clare Cameron that Council appoint a replacement member to the vacant position, at their earliest opportunity.

APPROVED.

Moved by Councillor Clare Cameron that Drew Chapman be appointed to the position of Chair.

APPROVED.

Moved by Councillor Al Bisback that Rita Trudeau be appointed to the position of Vice Chair.

8. Business

8.1 MHC-19-038 - 169 Victoria Street - Heritage Permit Application - Exterior and Front Siding

Connie Tintinalli, Chapman Murray Associates Architects Inc, was in attendance regarding the matter and delivered a presentation to such.

The Committee discussed the application.

Moved by Councillor Al Bisback that the recommendations contained in MHC-19-038 - 169 Victoria Street - Heritage Permit Application - Exterior and Front Siding, be approved as follows:

1.1 The Heritage Permit Application to remove and replace cement board siding, corner posts, soffit, fascia, frieze board, decorative shingles and moulding on the dwelling at 169 Victoria Street, with that of wood materials be approved, subject to the condition that if any change in colour is proposed for the exterior of the dwelling, the applicant receive approval from the Director of Community and Development Services.

APPROVED.


8.2 MHC-19-039 - 114-122, 126 Queen Street, 115-119 Johnson Street, 129 Johnson, 219 Victoria Street & 222 Gate Street

David Jones, owner, was in attendance regarding the matter and delivered a presentation to such. The Committee discussed the application.

Moved by Councillor Clare Cameron that the recommendations contained in MHC-19-039 - 114-122, 126 Queen Street, 115-119 Johnson Street, 129 Johnson, 219 Victoria Street & 222 Gate Street, be amended as follows:


1.1 the Heritage Permit Application to temporarily relocate the structure locally referred to as the "Smithy" building from 114-122, 126 Queen Street, 115-119 Johnson Street, 129 Johnson and 219 Victoria Street to the residential property at 222 Gate Street and then back to the original properties, as per the specifications provided by Merit Contractors Niagara Ltd and dated September 20, 2019, be approved, subject to the following conditions:

        a) Prior to relocation of the dwelling, an amendment be provided for the Temporary Protection Plan to include detailed specifications to be peer-reviewed by a structural engineering review done by licensed in the Province of Ontario and mapping for the relocation of the Smithy;

        b) Prior to any soil disturbance as a result of relocation of the Smithy building or the removal of the gravel, that the conservation of archaeological resources be addressed as required by the Ministry of Tourism, Culture and Sport who must confirm that all licensing requirements have been met and there are no further archaeological concerns, and that all archaeological reports and associated compliance letters be submitted to the Town.
1.2 condition 1.1 of this report be cleared to the satisfaction of the Director of Community and Development Services.

1.3 no charges be pursued under the Ontario Heritage Act, as this time, for alterations to landscaping on the property at 222 Gate Street, undertaken without Council approval and a Heritage Permit.

APPROVED AS AMENDED.

8.3 MHC-19-040 - 58 Johnson Street - Heritage Restoration & Improvement Grant and Heritage Permit - Repaint Early Dwelling

Robert McEwen, owner, was in attendance regarding the matter and delivered a presentation to such. The Committee discussed the application.

Moved by Councillor Clare Cameron that the recommendations contained in MHC-19-040 - 58 Johnson Street - Heritage Restoration & Improvement Grant and Heritage Permit - Repaint Early Dwelling, be approved as follows:

1.1 the Heritage Restoration & Improvement Grant ("Heritage Grant") and the Heritage Permit Applications to repaint the early building as per the quote and specifications provided by Robert McEwen, General Contractor, at $18,871.00, with the Town and Niagara Region each providing $4,714.75 in grant funding (Regional funding subject to availability) be approved for 58 Johnson Street, subject to the following conditions:
        a) all requirements of the Heritage Grant program implementing By-law 3989-05, as amended, be fulfilled;

        b) the applicant enter into a Heritage Grant Agreement with the Town prior to release of grant money, for the approved Heritage Grant at 58 Johnson Street; and

        c) the Director of Community and Development Services reserves the right to reduce the amount of grant funding released if the final invoice for the project is less than the approved amount in condition 1.1.
1.2 that condition 1.1 of this report be cleared to the satisfaction of the Director of Community and Development Services.

8.4 MHC-19-041 - 135 Johnson Street - Heritage Restoration and Improvement Grant and Heritage Permit - Construct wood storm windows and window shutters

Drew Chapman previously declared a conflict of interest with 135 Johnson Street - Heritage Restoration and Improvement Grant and Heritage Permit - Construct wood storm windows and window shutters as he has involvement with the property.

Denise Horne explained the application to the Committee. The Committee discussed the application.

Moved by Councillor Al Bisback that the recommendations contained in MHC-19-041 - 135 Johnson Street - Heritage Restoration and Improvement Grant and Heritage Permit - Construct wood storm windows and window shutter, be approved as follows:

1.1 the Heritage Restoration & Improvement Grant ("Heritage Grant") and the Heritage Permit Applications to construct and install 22 wood shutters and 11 wood storm windows, as per the quote and specifications provided by Canada Custom Shutters at $8,899.88 and Crowland Sash $4,746.00, respectively, with the Town and Niagara Region each providing $3,411.47 in grant funding (Regional funding subject to availability) be approved for 135 Johnson Street, subject to the following conditions:
        a) all requirements of the Heritage Grant Program implementing By-law 3989-05, as amended, be met;

        b) the applicant enter into a Heritage Grant Agreement with the Town prior to the release of grant money, for the approved Heritage Grant at 135 Johnson Street.

        c) the Director of Community and Development Services reserves the right to reduce the amount of grant funding released if the final invoices for the project are less than the approved amount in condition 1.1.
1.2 that condition 1.1 of this report be cleared to the satisfaction of the Director of Community and Development Services.

8.5 MHC-19-042 - 285 Simcoe Street - Heritage Restoration & Improvement Grant and Heritage Permit - Repaint Dwelling

Denise Horne explained the application to the Committee. The Committee discussed the application.

Moved by Amanda Demers that the recommendations contained in MHC-19-042 - 285 Simcoe Street - Heritage Restoration & Improvement Grant and Heritage Permit - Repaint Dwelling, be approved as follows:

1.1 the Heritage Restoration & Improvement Grant ("Heritage Grant") and the Heritage Permit Applications to repaint the dwelling as per the quote and specifications provided by Primary Coatings Ltd., at $7,910.00, with the Town and Niagara Region each providing $1,977.50 in grant funding (Regional funding subject to availability) be approved for 285 Simcoe Street, subject to the following conditions:
        a) The clapboard be sanded by hand, and that the paint be applied by brush;

        b) all requirements of the Heritage Grant program implementing By-law 3989-05, as amended, be fulfilled;

        c) the applicant enter into a Heritage Grant Agreement with the Town prior to release of grant money, for the approved Heritage Grant at 285 Simcoe Street; and

        d) the Director of Community and Development Services reserves the right to reduce the amount of grant funding released if the final invoice for the project is less than the approved amount in condition 1.1.
1.2 that condition 1.1 of this report be cleared to the satisfaction of the Director of Community and Development Services.

8.6 MHC-19-043 - 18 Prideaux Street - Heritage Restoration & Improvement Grant and Heritage Permit - Construct Wood Shutters, Windows, Storm Windows and Screens

Drew Chapman previously declared a conflict of interest with MHC-19-043 - 18 Prideaux Street - Heritage Restoration & Improvement Grant and Heritage Permit - Construct Wood Shutters, Windows, Storm Windows and Screens as he has involvement with the property.

Denise Horne explained the application to the Committee. The Committee discussed the application.

Moved by David Parker that the recommendations contained in MHC-19-043 - 18 Prideaux Street - Heritage Restoration & Improvement Grant and Heritage Permit - Construct Wood Shutters, Windows, Storm Windows and Screen, be approved as follows:

1.1 the Heritage Restoration & Improvement Grant ("Heritage Grant") and the Heritage Permit Applications to construct nine (9) wood louvred shutters, two (2) wood six-over-six sash windows, two (2) wood storm windows and two (2) wood screens, as per the quote and specifications provided by Drew Chapman Carpentry at $21,357.00, with the Town and Niagara Region each providing $5,000 in grant funding (Regional funding subject to availability) be approved for 18 Prideaux Street, subject to the following conditions:
        a) all requirements of the Heritage Grant program implementing By-law 3989-05, as amended, be fulfilled;

        b) the applicant enter into a Heritage Grant Agreement with the Town prior to release of grant money, for the approved Heritage Grant at 18 Prideaux Street; and

        c) the Director of Community and Development Services reserves the right to reduce the amount of grant funding released if the final invoice for the project is less than the approved amount in condition 1.1.
1.2 that condition 1.1 of this report be cleared to the satisfaction of the Director of Community and Development Services.

8.7 MHC-19-044 - 159 King Street - Heritage Restoration & Improvement Grant and Heritage Permit - Build, Paint and Install Shutters

Drew Chapman previously declared a conflict of interest with MHC-19-044 - 159 King Street - Heritage Restoration & Improvement Grant and Heritage Permit - Build, Paint and Install Shutters as he has involvement with the property.

Denise Horne explained the application to the Committee. The Committee discussed the application.

Moved by Amanda Demers that the recommendations contained in MHC-19-044 - 159 King Street - Heritage Restoration & Improvement Grant and Heritage Permit - Build, Paint and Install Shutters, be approved as follows:


1.1 the Heritage Restoration & Improvement Grant (the "Heritage Grant") and the Heritage Permit Applications to build, paint and install 10 (ten) pairs of wood shutters with period appropriate hardware as per the quote and specifications provided by Drew Chapman Carpentry at $21,018.00, with the Town and Niagara Region each providing $4,395.58 in grant funding (Regional funding subject to availability) be approved for 159 King Street, subject to the following conditions:
        a) all requirements of the Heritage Grant Program implementing By-law 3989-05, as amended, be met;

        b) the applicant enter into a Heritage Grant Agreement with the Town prior to the release of grant money, for the approved Heritage Grant at 159 King Street; and

        c) the Director of Community and Development Services reserves the right to reduce the amount of grant funding released if the final invoice for the project is less than the approved amount in condition 1.1.
1.2 that condition 1.1 of this report be cleared to the satisfaction of the Director of Community and Development Services.

9.1 - Update on Workplan

Denise Horne provided a brief update on the status of the current workplan. A formal update is forthcoming at the next meeting.
